Although anyone can get sepsis, the elderly population is at a higher risk than other demographics for contracting the disease.

Diagnosing Sepsis

Sepsis is diagnosed when a patient has an inflammatory response to an infection in the body. This response can cause severe illness in patients. Sepsis can also lead to septic shock. In these severe forms, sepsis results in a loss of blood flow to organs and tissues, causing tissue death and organ failure. As this process continues, the patient's risk for death increases.

Risks for The Elderly

Elderly patients with sepsis face a high mortality rate and have many risk factors for contracting the disease. One issue is lack of functioning or mobility. Most people slow down in activity when they age. Older persons also experience cognitive decline, muscle loss, and hormonal and metabolism changes. All these changes make it more difficult for an older person to fight off an infection.

Other risks associated with elderly patients are more co-morbidities and prescription medications that may make it harder for the body to overcome an illness. Older adults are also more likely to have nutrition issues, endocrine disorders and exposure to drug-resistant organisms found in congregate settings.

Sepsis is also harder to diagnose in older patients as the immune response of elderly persons is not as evident as in other populations. Sometimes, the inflammation is not apparent until the disease has progressed to a more severe stage.

Elderly persons should maintain a healthy diet and lifestyle to combat sepsis and other illness.

Despite promising to protect and care for your loved one, nursing homes are responsible for the abuse millions of older adults face annually. Along with predictions that the global population of people over age 60 will double over the next 50 years, many anticipate a rise in elder abuse.

Still, abuse that occurs within the confines of a nursing home calls for accountability and damages to victims and their families.

Signs Of Nursing Home Abuse

Your loved one may not have the ability or desire to communicate the specific details of their mistreatment in a nursing home, but recognizing the signs of abuse can prevent further damage. Physical clues include weight loss, lacerations, bruises and bedsores that staff fails to address. In addition, fear of touch, agitation, anger or obsessive behavior may indicate emotional abuse.

Possible Damages

It is vital to act quickly on your suspicions by relocating your relative. Next, you should file a complaint with your local protective services agency and the offices of the Attorney General and Inspector General.

Next, you must gather evidence proving that your relative's physical and mental injury is directly due to the facility's failure to meet its obligations and duty of care. A successful claim may lead to compensatory damages covering necessary medical treatment. A Kentucky judge or jury may also agree that a victim should receive uncapped non-economic damages for pain and suffering and the emotional toll from experiencing abuse. Defendants may also pay punitive damages and funeral and legal expenses when abuse leads to someone's death or severe harm.

Nursing home abuse stories should not deter you from considering these facilities for yourself or your loved ones, but knowing how to proceed at the first signs of a problem can lead to a favorable outcome.

But unfortunately, if your loved one's health deteriorates while living at a facility, you may experience feelings of hopelessness and betrayal.

However, you can take steps when you suspect your parent suffers the consequences of abuse or medical malpractice.

What Are Common Forms Of Abuse?

Common red flags indicating your parent may be a victim of nursing home abuse may include:

Bedsores

Weight loss

Bruises and lacerations

Excessive sleepiness

Agitation

Inexplicable bank account transfers

The following organizations can launch an investigation or help relocate your parent if the nursing home's administration dismisses your concerns.

Kentucky Department for Community Based Services

Office of Inspector General, Division of Health Care Facilities and Services

Office of the Attorney General

Long-Term Care Ombudsman Agency

Kentucky State Police Department

What Qualifies As Medical Malpractice?

Nursing homes are also responsible for harm resulting from medical negligence and errors by staff members who:

Do not have appropriate medical training

Fail to consider drug interactions or proper dosages

Disregard residents' symptoms

Fail to monitor vital signs

Fail to report a need for urgent care

Misdiagnose new symptoms

You may file a medical malpractice claim against a nursing home when mistakes and negligence lead to severe or irreparable harm. In Kentucky, you have one year to file a court claim and must prove that another nursing home would avoid the same outcome through appropriate care under comparable circumstances. Also, you must show that your parent's condition is directly due to a failure to provide reasonable medical care.

Although most nursing homes have high standards of care, immediate action is critical when you suspect abuse or medical malpractice.

Individuals trust that a nursing home staff will provide the care and attention their elderly loved ones require. From proper hydration and nutrition to the dispensing of medication and proper use of safety restraints, a nursing home staff must continuously monitor their residents. Unfortunately, a nursing home staff member might abuse the resident rather than care for them.

In general, experts categorize nursing home abuse in five ways:

Physical: Broken bones, torn ligaments, bruising and lacerations are all indications of serious physical trauma. When a nursing home staff member abuses a resident, the resident can exhibit countless signs of bodily harm.

Emotional: While physical abuse leaves visible damage, emotional abuse can lead to mental anguish and cognitive impairment. Common forms of emotional abuse include name-calling and bullying.

Sexual: When the nursing home resident suffers unwanted contact or nonconsensual sexual activity, he or she has suffered abuse at the hands of the nursing home staff.

Financial: An elder can suffer financial abuse in numerous ways. From cash stolen from the bedroom to online credit card purchases, the nursing home staff has access to numerous sensitive records.

Neglect: If the nursing home staff neglects to provide the proper food and water, the elderly resident can suffer from malnutrition and dehydration. If the nursing home staff fails to ensure the elderly resident is repositioned at regular intervals, he or she might suffer from bedsores.

What Is Polyvictimization?

Polyvictimization (PV) is a term that has seen increased usage in recent years. It can apply to two scenarios:

A victim that suffers different types of abuse at the hands of one individual

A victim that suffers abuse at the hands of numerous individuals

Elderly nursing home residents can suffer many types of abuse at the hands of the facility’s staff. Unfortunately, many of these forms of abuse have a cascading effect – one abuse leading to another type and so on. Victims can suffer physical pain and visible symptoms, or they can exhibit emotional symptoms such as anxiety, depression and withdrawal. A negligent or abusive nursing home staff must be held accountable for these actions.
